What is BAPCPA?

The Bankruptcy Abuse Prevention and Consumer Protection Act, or BAPCPA, was passed in 2005 in order to prevent too many debtors from filing Chapter 7 bankruptcy. This act established the means test, which verifies whether or not a Chapter 7 filer is actually able to pay off some of his or her debts. Should one fail the means test, he or she cannot file Chapter 7, but may file Chapter 13 bankruptcy instead.
