Foreclosure rate doubled from last year

According to the latest data from Fitch Ratings, foreclosures are almost two times as high as they were at the same time last year.

The agency uses Residential Mortgage-Backed Security, or RMBS, Performance Metric.  Their most recent findings indicate that the rate of foreclosure on homes with delinquent mortgages has increased to 10 percent a month.

Officials say the apparent increase in foreclosures is related to last year’s discovery of problematic procedures in the foreclosure industry like “robo-signing” and the subsequent delay in many foreclosure proceedings.

Experts predict that home prices in the U.S. will drop by about 10 percent in the months to come.

Personal bankruptcies continue to fall in October

In October, personal bankruptcies decreased for the fourth consecutive month.  Experts suspect the decline in consumer bankruptcy filings is related to a decrease in the use of credit.

Executive director of the ABI Samuel Gerdano stated, “The declining filings correlate to tightened consumer spending and the overall pull back in consumer credit associated with a stagnant economy.”

This week, the National Bankruptcy Research Center and the American Bankruptcy Institute released data on bankruptcies filed in the U.S. in the month of October.  According to the two, a total of 106,255 personal bankruptcies were filed across the country last month.

Compared to October 2010, 19.6 percent fewer personal bankruptcies were filed in the U.S.  Last month’s personal bankruptcy filings also experienced a 2.1 percent month-over-month decrease.

Lehman Brothers has plan to exit bankruptcy

This week, Lehman Brothers Holdings Inc. announced that their plan to exit bankruptcy has the approval of their creditors.  Lehman’s creditors hold about $160 billion of the investment bank’s debt.

The bank has 9 new settlements that they believe will provide enough approval from debt holders to end their bankruptcy in the near future.

Creditors have until November 4 to vote on Lehman’s bankruptcy exit plan.  The exit plan would pay back all creditors a total of $65 billion out of $320 billion in allowed claims.

The next hearing in the case will be held December 6.

Solar-power equipment manufacturer files for Ch. 7

Sterling Energy Systems Inc., a manufacturer of solar-power equipment, recently filed for Chapter 7 bankruptcy.  The company is based in Scottsdale, Arizona.

Executives with Sterling Energy Systems say that rising costs, low demand, and trouble raising funds has hurt their business.  Sterling reportedly tried to find a buyer, but did not find anyone and decided to file for bankruptcy instead.  Under Chapter 7 bankruptcy, the company will be able to eliminate their debts.

The company’s Chapter 7 filing lists between $1 million and $10 million of assets and between $50 million and $100 million in debts.

Several other solar-power companies have recently filed for bankruptcy as the industry struggles.

Foreclosure filings up in third quarter

Recent data shows that nationwide foreclosure filings increased in the third quarter of this year.  This is the first quarter that foreclosure filings have increased since the last quarter of 2010.

1 in 213 properties in the United States were foreclosed upon in the third quarter of 2011.  In total, 610,337 properties were repossessed.

Experts predict there will be a total of between 2 million and 2.1 million foreclosures this year, or 30 percent fewer foreclosure than last year.

CEO of RealtyTrac, a real estate statistics provider, James Saccacio says, “There is evidence that this temporary downward trend is about to change direction, with foreclosure activity slowly beginning to ramp back up.”

Personal bankruptcies down nationwide

Last month, a total of 108,517 personal bankruptcies were filed nationwide.  September’s personal bankruptcy filings were 4 percent lower than a month before and 17 percent lower than a year before.

Furthermore, the number of personal bankruptcies filed in the U.S. from the beginning of the year through September was 10 percent lower than the number of personal bankruptcies filed in the same time period last year.

70 percent of personal bankruptcies filed in September were Chapter 7 filings and 30 percent were Chapter 13 bankruptcies.

Data comes from the American Bankruptcy Institute and National Bankruptcy Research Center.  Samuel Gerdano, executive director of the ABI, says, “Total consumer filings for 2011 will be less than 2010.”

Media personality files for Ch. 7 bankruptcy

Earlier this month, “Troubleshooter” Tom Martino filed for Chapter 7 bankruptcy.  Martino hosts television and radio shows on consumer-advocacy based in Denver, Colorado.

Martino says that all of his debt is related to commercial real estate projects and that he has zero consumer debt.  The majority of the 47 creditors listed in the bankruptcy were banks that Martino had real estate loans from and had failed.

The Chapter 7 bankruptcy filing lists $78.6 million in debt and $1.37 million in assets.  Martino said, in regards to the filing, “There are so many people in this same boat.  You’ve got millions of dollars in lost value and all of a sudden you can’t refinance your loans and you are just upside down.”

Foreclosures down by 29 percent in August

Real estate research firm RealtyTrac recently reported that foreclosure filings experienced a 29 percent year-over-year decrease in Alabama in August.

Last month, a total of 1,358 foreclosures were filed in the state.  711 of the foreclosure filings were notice of trustee sales and 647 of the foreclosure filings were real estate-owned properties.

In addition, 1 in every 1,607 homes in Alabama was in foreclosure, according to last month’s foreclosure data.

Nationwide, foreclosure filings experienced a year-over-year decrease of 32.7 percent in August.

Former state representative files for bankruptcy

Former Alabama State Representative James Gordon recently filed for bankruptcy protection for himself and his business, the Alabama Injury and Pain Clinic.

The business filed for Chapter 11 bankruptcy in hopes of reorganizing and continuing operations. Gordon also filed for personal bankruptcy, choosing Chapter 13 bankruptcy. Under Chapter 13, the former representative will pay back creditors according to an established repayment plan and timeline.

According to Gordon, the business and his personal finances suffered as a result of the economic recession and his time spent away from the Alabama Injury and Pain Clinic while in office.

Birmingham-Hoover foreclosure rate increasing

A recent report from CoreLogic says that the foreclosure rate in the Birmingham-Hoover metro area is increasing.

In June, the foreclosures in the area increased by 1.67 percent from May.  In addition, June foreclosures in Birmingham-Hoover were 1.43 percent higher than the number of foreclosures in the area in June 2010.

The foreclosure rate for the area is predicted to be about 6.09 percent — lower than both the national foreclosure rate and Alabama foreclosure rate.

Data also revealed that mortgage delinquencies in the area are decreasing.  6.14 percent of mortgage loans in Birmingham were delinquent by 90 days or more.  At the same time last year, the mortgage delinquency rate was 6.77 percent.
